European Protection of People with Disabilities in Lands Triggered by Natural Hazards - An Unfinished Matter

Sažetak
Between 1980 and 2020, natural disasters incurred 487 billion Euros in economic damage in the European Union. The escalating frequency of such events necessitated emergency legislation for protecting affected individuals’ rights. However, the effectiveness of European Disaster Risk Management policies is hindered by complexity, potentially limiting evacuees’ fundamental rights like housing and healthcare access. Furthermore, the regulatory framework lacks provisions safeguarding people with mental and physical disabilities during disasters. Despite the absence of explicit regulations, an investigation into the European Court of Human Rights jurisprudence suggests a fundamental right to remain in one’s homeland. Notably, all EU Member States have ratified the 2006 Convention on the Rights of Persons with Disabilities, endorsing equal rights for individuals with disabilities. This study, utilising qualitative methods, seeks to propose legally viable solutions, such as a multi-party protocol, to enable those with disabilities to continue residing in their homeland in the aftermath of a natural hazard.
