Abstract

The role of historians as expert witnesses at the International Criminal Tribunal for the former Yugoslavia (the “ICTY” or the “Tribunal”) is reexamined in the light of the objectives, which the Tribunal is supposed to establish. This paper discusses whether at all or to what degree historians as expert witnesses can fulfill such role within the framework of the ICTY procedural and evidentiary rules. Taking these findings into consideration the article seeks to determine the extent to which historians should be used as expert witnesses in front of the ICTY.
