Abstract

The subject of this paper is the activity of the police force under Article 5 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, and whose activity is also appropriately governed by the relevant domestic laws. The essence of these activity procedures is bro-ught down to the action of the police during the deprivation (seizure) of freedom and the proceedings to keep the suspects in custody. In this regard, we state the specific cases from the practice of the Eu-ropean Court of Human Rights and the European Commission, from whose judgments and views is evident what the police should or should not proceed, in order not to be a violation of Art. 5 of the European Convention.
