Abstract

Thee author analyses the liberal and the democratic pnncrples of
government constitution and their functioning within the parliamentary
framework. According to the author, the liberal principle has always been
bound to parliamentarism. The democratic principle, however, particularly
in the form of democratic despotism, is a fervenl opponent of
parliamentarism. The author rejects Schmitt's concept of parliamentarism
and like Troeltsch emphasizes thc natural right as the spiritual foundation
of parliamentarism. Finally, the author points to the absence of the liberal
principle in the post-war development of Yugoslavia and talks about the
painstaking process of coming to terms with the principle in presentday
Croatia.
