Abstract

Temporary agency work is an atypical form of employment that is becoming
more frequently used as an alternative to standard labour relationship. It is a complex,
‘triangular’ legal relationship, which involves temporary-work agency, employee
employed by the agency and a user firm, to which the agency assigns the employee.
This article analyses the characteristics of this unique, flexible form of employment
in Croatian, European and comparative law and jurisprudence. A special attention is
given to a recent case before the European Court of Justice (case Akt ry v. Öljytuote
ry, Shell Aviation Finland Oy C-533/13).
