Partial Expropriation and Entries in Land Registries - Regulations and Practice

Abstract

Partial expropriation represents a limitation on the right of ownership, so in the case when partial expropriation is carried out on a property, by the establishment of an easement or lease, then the owner of the property has a right to compensation at the market value of the property, i.e. the amount by which the market value of the property is reduced, or by compensation as a rental charge. In implementing major communal infrastructure projects for the renovation of water and sewer networks throughout Croatia, resources from the funds of the European Union are used, and investors may encounter major problems because of unclear legal property relations or, unclear records about property. This work tries to respond to questions from practice, the means by which investors can start, because they cannot begin to build if the legal property rights have not been resolved.
