Enforcement on Motor Vehicles

Abstract

This paper presents an analysis of the special provisions dealing with enforcement on motor vehicles, while emphasising the problems that this raises in practice. The paper presents data on the relevance and scope of this instrument in the domestic legal order, while giving specific suggestions for improving its efficiency. The execution of enforcement on motor vehicles is compared with the solutions offered in German law. The author also presents an initiative of the European legislation regarding the obligatory introduction of an e-call system as a technological innovation in the automotive industry. Its proper application in the enforcement procedure would resolve one of the major causes of the inefficiency of enforcement on motor vehicles, the problem of identifying their location.
