Abstract

In this paper, the author presents an overview of the rules that regulate the legal status of warships in contemporary international law. To begin, a legal definition and the general characteristics of a warship are given. The first part of the paper presents the legal basis of the exemption of such vessels from jurisdiction and the rules relevant for their navigation and the right of inspection and prosecution in maritime zones, all focusing on the territorial sea, archipelago waters and the open sea. In the second part, the author points out specific rules that show the specificities of the legal status of a warship as one of the subjects of armed conflict, and the effect of the right of neutrality is also explained in this context. The final part contains a conclusion related to the nature of the rules of international law which determine the legal status of warships.
