Instruments of Self-Regulation and Co-Regulation and Their Role in Regulation of Electronic Media

Abstract

The primary purpose of this paper is to analyze the instruments of self-regulation and co-regulation and their role in achieving better regulation of audiovisual media services and electronic publications (online newspapers). The role of independent regulatory bodies within the legislative process is examined, with an emphasis on their participation in the process of self-regulation and co-regulation. Furthermore, the importance of formal and real independence of regulatory bodies is discussed together with the influence of convergence of technologies. The development of technology and information society imposes a need for wider regulation of media content. Although, there are many proponents of liberalization of media regulation, primarily through forms of self-regulation, in our opinion co-regulation is the more effective instrument. It is only through co-regulation that the state and its regulatory bodies can fulfill their basic functions of oversight, administration and support. Finally, we discuss some specific domestic legal norms that are related to self-regulation and co-regulation and try to offer suggestions de lege ferenda that are in accordance with the regulatory framework of the European Union.
