Croatian Family in a Gap between Traditional Concepts and International Expectations

Abstract

Family as the basic social unit and marriage as its core on which the future of the human species and the survival of the civilisation relies, are passing through the most turbulent times, both on the international and, unavoidably, national scale. The basic natural precepts from which the family has emerged and by which it (still) exists are denied. Jurisprudence is at least partly responsible for creating the present picture of family-law reality. This is clearly evident in the recent attempts of the United Nations, the European Council and the European Union, the wording of numerous international documents, case-law of the European Court of Human Rights and the Court of Justice of the European Union, and comparative law experience. It seems as if everything is pursuing some new views of the family-law reality.
