Abstract

In the introduction the author presents a chronoloqy o f legal formation of the basis of the system of local self-government in the Republic of Croatia, beginning from the adoption of the fundamental Local-government and Administration Act at the end of 1992.
The author has in his text particularly turned to the recognized defects of the primary conceptualized system of local self-government, and offers a presentation of primary functioning of the uniform units of local self-government, with a review of problems and difficulties in practice. The text separately explores the basic institutions of local self government such as, for instance, the institute of expressing non-confidence to a chairman of the collective head of an unit of local self-government, the authority of the chairman of a collective head to dissolve a representative body, and the work and powers of the Republic of Croatia Government’s commissioner.
Separately are explored than new proposed solutions, which have been incorporated into the Bill on Changes and Supplements to the Local Self-government and Administration Act, as well as the new institutions, at the first place an institutionalization and elaboration of cooperation of the local self-government units and a separation of the function of a prefect onto its self-government and the state elements, and simultaneously gives a review and explanation for reasons which had motivated the proponents to propose the particular solutions.
In his conclusion the author puts for ward the thesis about a necessity o f a comprehensive reform o f the existing System o f local self-government, which would aim to ensure further development of local self-government as a form of direct democracy. The author also points to the necessity of unconditional amending the very Law on Financing Units o f Local self-government and Administration, and an adoption of a statute on labor relations within the units o f local self-government which would encompass the whole area o f labor law relations and a status of employees. By adoption of the mentioned acts the System o f local self-government would be completely and meaningfully encompassed and by that the adequate and applicable for the future.
