Abstract

The paper analyses the most important international standards concerning the protection of asylum seekers in the context of access to the asylum system and reception of asylum seekers in the asylum country. Independent countries, as part of their sovereignty, have right to control the entrance, residence, and banishment of foreign citizens from their territory. That right is limited by the rules of international
law. Although we cannot speak about the right of obtaining asylum,
the right to seek asylum is guaranteed by international law and EU law. Access to the asylum system is the first step in the procedure that enables individuals to exercise their right to asylum as it is determined by international and European documents for the protection of human rights and fundamental freedoms. Along with basic international documents governing the field of refugee law, the paper presents and analyses the recommendations of the most important international
organisations involved in the protection of refugees, primarily the UNHCR. Further, the paper analyses the relevant EU acquis communautaire concerning access to asylum and reception of asylum seekers in the EU.
