Abstract

In this paper the author deals with problems concerning the unification of the sea-shipbuilding law. This law consists of all provisions regulating legal issues connected with building, reconstruction and shiprepair in shipyards located on the sea.
Since the shipbuilding law consists of national laws and international conventions, the author begins with the analysis of the Croatian maritime law as well as the laws of the leading maritime countries. He then turns to those international conventions which deal with issues important for the shipbuilding law.
The laws and regulations dealt with in this paper involve both public law and private law aspects of shipbuilding, which are subject not only to national and international legislation, but also to the formular law in the field of shipbuilding.
The author emphasizes the need for the wide use of formular contracts in shipbuilding, as well as the necessity that the matter of shipbuilding contracts be unified by international codification through IMO and CMI.
