Abstract

Although the Croatian Maritime Code is a very successful codification, the author percieves certain mistakes in the text which are sometime the result of technical omissions (lapsus calami), yet may undoubtedly cause various dilemmas of legal scope.
This paper points out the problem of the operator's liability for damages arising from death or personal injuries of a crew member. It also emphasizes lapsuses in the field of the general limitation of the operator's liability, liability both for the damages caused to the goods and for delays. It warns against the use of one of the terms of the non-liability cause for oil pollution damage outside the ship carrying oil.
