Abstract

The new Croatian Maritime Act came into force on March 22th 1994. Bearing in mind the important role of maritime hypothecs and maritime liens in ship financing, the author analyzes the provisions of the new Maritime Act in relation to maritime hypothecs and maritime liens.
The author arrives at a conclusion that some useful changes have been made only in relation to hypothecs, whereas the system of maritime liens is still shaped according to the International Convention for the Unification of Certain Rules relating to Maritime Liens and Mortgages, 1926.
It should be stressed that the new Croatian Maritime Act introduces hypothecs ''sui generis'' which grant to the creditor, in addition to the court sale of the ship, the right to enter into possesion in the case of the default of debtor.
