Abstract

A dispute between a creditor and a debtor is not being deemed as a maritime dispute if it refers to paying off a credit. The fact that a ship is encumbered with hypothec is not essential in this case. If steps were taken for the realization of hypotec or in connection with being in encumbrance, it would then be deemed as a maritime dispute. So the Communal Court is competent in deciding disputes arising from the paying off a credit, regardless of the fact that the ship is in encumbrance for the credit.
