Abstract

Notwithstanding the provision contained in the adopted Law of Contracts on Transportation in Railway Traffic which makes all the railways participating in the performance of a voyage jointly and severally liable to contracts concluded before the entry into force of the mentioned law, the former law, and in particular Article 1006 of the Law of Obligations is applied. This means that the railway on whose territory the damage occurred is liable for that damage. If the seals have been removed from the wagon, and the missing part of the cargo is properly established, the railway on whose territory the seals have been removed is liable for the damage.
