Abstract

If the vessel is bareboat chartered, the bareboat charterer is liable for all obligations arising out of the contract for carriage of goods by sea. The same is also true when the ship's master signed a bill of lading in the capacity of the charterer's representative. A shipowner or a person who uses the vessel is considered as the ship's operator until the opposite is proved. According to Yugoslav law it is not necessary for such a person to be entered as ship's operator in the relevant vessel folio of the registry for seagoing vessels.
