Abstract

On the bases of Articles 84.85 and 87 of the Treaty of Rome 1957, the EEC Council introduced in 1986 Regulations relating to sea transport which regulate shipping policy within the EEC and between EEC member states and third countries. Regulations are published in the Official Journal of the European Communities under reference numbers 4055/86, 4056/86, 4057/86 and 4058/86.
Regulation 4055/86 deals with existing bilateral cargo sharing agreements between EEC members and third countries and gives the dates by which these arrangements have to cease in order to minimize unfair competition in shipping involving the EEC.
Regulation 4056/86 sets aside all existing restrictions and limits on sea transport within the EEC but it does not apply to tramp vessel services.
Regulation 4057/86 deals with compensation for damages caused by price ''dumping'' and governmental subsidies for sea transport services and by unfair competition. It also stipulates the procedure for establishing claims for damages and for enforcement of penalties.
Finally, Regulation 4058/86 prescribes terms and conditions under which the EEC will insure free access to cargoes for sea transport within the EEC and between it and third countries.
These Regulations came into force on 1st July 1987.
