Abstract

Provision and availability of public services in the concept of social state of 20th century became essential for legitimation of public authority. It can be seen from the penetration of neoliberal ideas to the mainstream politics during the late seventies that transformation of the watchman state into the social state is not irreversible. Orientation of the new public management to the achievement of economic values has not been overcome. In the context of European Union this is best depicted in the organisation of services of general (economic) interest and by subordination of the social character of some services to the rules of internal market only by the fact of potential existance of the market for these services. In contemporary reality of EU member states it is possible to talk about social deficit of the Union. From the Croatian point of view it is undisputed that socially aware and economically neutral Constitution remains the foundation of social state.
