Abstract

This paper discusses the definition of the lien on cargo in doctrine, as well as in the provisions of the Maritime Code. The differences are analysed according to the location of the provisions regarding the lien on ship and the lien on cargo in the Maritime Code. There is a close connection between the arrest of the ship and arrest of the cargo although with different results. A difference exists between “stoppage in transit” and arrest of cargo due to privilege. Special attention is paid to the study of the position of a ship flying a foreign flag while in Croatia, since no specific provisions are provided for in the Maritime Code.
