Abstract

In the introduction the author explains the actuality of the theme in the contemporary pastoral of the family; in the first chapter the basic principles of Christian marriage are outlined, according to the Canon Law. In the second chapter, possible elements for the invalidity of the marriage are listed: in the field of the Canonical form, legal incapacity, or marital consent. Special attention is given to the motives of the invalidity of the marital consent, due to their relative frequence: psychological disorders, intentional deceit, complete or partial exclusion of the marriage, moral coercion. In the third, final chapter the author clarifies the role of the parish vicar and the role of other collaborators in the work with the divorced and civilly remarried persons, in cases when some of the above mentioned elements for the invalidity of the canonical marriage are present. In few words, the above mentioned pastoral workers should be the first filter between the parties and the church courts.
