Abstract

This paper presents an investigation of the effectiveness of the appellate procedure in the case of speeding
offenses in the area of the Zagreb Police Administration, ie the Misdemeanor Court in Zagreb. The
investigation was carried out on an appropriate sample of cases found on the shelves of the misdemeanor
court in Zagreb, formed on the basis of objections to mandatory misdemeanor warrants issued by the
Zagreb Police Administration. The analysis was performed on the following items: gender and age of
the defendant, ground of appeal, type of verdict on the complaint, reasoning of the verdict, whether the
statute of limitations occurred, whether the sentence was mitigated, whether police investigations were
undertaken, whether the offense was determined by fxed or mobile device for speed measurement, and
at whose expense the costs of the proceedings have fallen. These items were observed in relation to the
last signifcant amendment to the Road Trafc Safety Act, which entered into force on August 1st 2019,
which signifcantly tightened penalties for numerous offenses, including speeding. In order to determine
whether there was a change in the conduct of the police and the courts, the survey covered approximately
the same period and number of fles before or after the entry into force of the legal changes
