Abstract

As part of a grand reform of substantive criminal law in Croatia, the legislator has introduced some completely new security measures. One is protective supervision upon the full execution of a prison sentence, regulated in Art. 76 of the Croatian Criminal Code. Since it was introduced, this provision has been amended three times, on the last occasion in 2021. It is to be noted that this security measure is rather controversial and therefore rare in jurisprudence. The authors first present the previous legislative changes regarding this measure and explain the most significant theoretical and practical problems. Secondly, they analyse the latest amendments and discuss potential solutions de lege ferenda.
