Abstract

According to the constitution and law the independent and impartial judge
should try in a civil procedure in order to make a correct and legal decision. In this
paper the author deals with the exemption of the judge institute through the prism of
guarantying independent and impartial trial in the national legislature and Article 6
of the European Convention for the Protection of Human Rights and Fundamental
Freedoms. The humanity, ethics and the independence of judges are closely connected
when it comes to the public perception of the judiciary, which is no less significant
than the measurable results of the judiciary.
