Abstract

Refugee crisis 2015-2016 and the health-related COVID-19 crisis 2020-2023 in Croatia,
threatened the values protected by law and led to the limitation of subjective rights. A comparison
of crises, decisions during crises, the scientific and professional discourse on crises and
decisions provides insights into their common and distinguishing characteristics. Such insights
make it possible to identify problems for legal science, legal reasoning and legal policy related
to the understanding, application and regulation of emergency regimes. These theoretical and
practical problems can be solved using the theoretical tools offered by the theory of law. In this
article, we will use the institutional theory of law and the theory of rule application.
