Access to Social Rights in Flexible Employment: How to Realise Social Rights?

Abstract
The aim of this paper is to point out the connection between the access to social rights in the employment and the phenomenon of globalization and the process of flexibilization.During the 20th century, in the times of the welfare state expansion, social rights grew almost unrestrainedly until the contraction of the state social functions occurred towards the end of the 20th century. This process is particularly visible in the sphere of employment rights, where the globalization consequences change the historic context of labour legislation and the requests for flexibilization of labour legislation are put directly, which actually presents the request for the reduction of social rights in employment. The present situation is in danger of being misunderstood, of being accepted and followed unreservedly or of attempts to resist it, and both of those present risks for the existence of labour law and specific features of social rights in employment. The concluding part of the paper shows the possibility that social rights in employment can be reconciled with the global concept of flexibilization in the manner that social right should be redefined, together with the entire system of social security, and adjusted to new tendencies and forms of work.
