Digital Transformation of EU Public Procurement: Current Legislative Framework, State of Implementation and Future Directions

Abstract
This paper examines the paradox of digitalisation in EU public procurement: although extensive electronic infrastructure has been introduced since 2014, genuine transformation remains limited due to fragmented implementation across Member States. Near-term developments are likely to prioritise data analytics, interoperability, and oversight mechanisms rather than a mandatory true digital-by-default, end-to-end systems with integrated artificial intelligence. However, should this not be accomplished, contracting authorities will increasingly rely on external solutions, reinforcing the fragmentation EU policy sought to eliminate. Meaningful progress will require coordinated legislative, technological, organisational, and human action.
