Abstract

This paper argues for granting civil society access to procurement remedies, as a means to strengthen enforcement of sustainability requirements. By adopting a public interest lens, the author reevaluates the purpose and objectives of public procurement, with special emphasis on sustainability as one of its core values; this sets the background against which the watchdog role of civil society in public procurement is analyzed in comparative law and practice. The central part of the paper explores pathways and legal implications of vesting representatives of civil society with standing to seek procurement remedies. The final section of the paper synthesizes these findings, paving the way for the second part of the study.
