Abstract


SUMMARY: Safety at work is an integral part of organisation, work process and production. Each segment in the process needs to be governed by safety considerations and provide work conditions that prevent injury at work, occupational diseases and other work-related diseases. This applies also to the ‘minimum safety and health conditions on temporary and mobile construction sites’ set out in the Regulations on Safety at Work on Temporary or Mobile Construction Sites (N.N. no. 51/08) issued by the Minister of Economy, Labour, and Entrepreneurship, with authority to do so set out in Article 12 par. 1 of the Occupational Safety Act.
The paper analyses the provisions of the aforementioned Regulations from two points of view: primarily from the point of view of safety at work and with reference to the construction regulations and other ‘special regulations’. Provided in the paper are the terms, work plan, site registration, coordinator nomination, necessity to comply with the principles of safety at work in the project design stage and in the actual operational stage (obligations of the investor and contractor), obligations of contractors and other persons on the site, information, counselling and participation of workers, and the content of Annexes I-V of the Regulations.
The Regulations have been in force from 13.05.2008. and are to be implemented within one year of the day they became effective.
