Abstract

The author considers the meaning of the term „autochthony“, its comparative legal application and specific use in the legal system of the Republic of Croatia. As part of the Croatian constitutional law ever since the Preamble to the 1990 Constitution, it has proved by its very nature to be an instutute of discriminatory legal effect, having negative comparative legal connotations and has been used as a means of daily political trade-off with national minorities' rights. Since it is to be used in the same way in the newly proposed constitutional amendments of 2009-2010, the author is of the opinion that it should be permanently erased from the constitutional text.
