The Right of Access to Data Contained in the Medical Documentation

Abstract

Medical documentation is a document containing information on course of patient illness and treatment, i.e. on patient health condition, working methods at the place of providing health protection and guidelines which are given to achieve patient’s right to health protection. The described document is issued in medical facility and it is signed by the authorized health professional (in most cases by the physician).
After providing the explanation of the notion of medical documentation, the author in his article points at: purpose, content and types of medical documentation, duty to and modes of keeping the medical documentation, patient’s right to have an insight into his / her medical documentation as well as third party’s right of access to medical documentation, certain subordinate legislative acts governing medical documentation, content and duty to keep and safeguard it as well as consequences of breaching such duties. The final part of the article deals with responsibility for medical documentation keeping and protecting the privacy of data contained within.
