Sažetak

This paper analyzes three decisions of the Constitutional Court of Bosnia and
Herzegovina, namely: U-9/09 of 26 November 2010, U-23/14 of 1 December 2016 and
U-3/17 of 6 July 2017, and their impact on the Election Law of Bosnia and Herzegovina. The
common denominator of these three decisions is proclaiming the general principle of democracy
- the right to democratic decision-making by legitimate political representation.
These decisions give a clear answer to the question of legitimate political representation
in the houses of peoples, and in the houses of representatives, which is also applicable to
the members of the Presidency of Bosnia and Herzegovina, bearing in mind the fact of the
constituency and equality of peoples in Bosnia and Herzegovina. The implementation of
these decisions is extremely important for the stabilization of the overall relations in BiH,
and development of Bosnia and Herzegovina as a democratic state based on the equality
of three constituent peoples and all its citizens.
