Legal aspects of Bird Strike

Abstract

A bird strike occurs in once in 1,000 flights on average Croatian air traffic. Although there have been no human casualties in such incidents in Croatia, these events often cause substantial material damage to airports and carriers. The development of air traffic and the increase in the number of flights carries a higher probability of accidents caused by bird strike. Airports worldwide register tens of thousands of such accidents every year. The aim of this paper it to analyse the Croatian regulations concerning the issues of air traffic safety with regard to bird strike hazard, and investigate the effect of international and EU regulations on the domestic ones. The author pays special attention to the issues of liability of particular subjects in air traffic for damage sustained in such events. The paper also analyses the regulations concerning the rights of passengers in the event of aircraft accidents caused by a bird strike and considers the issue of liability for ground damage caused by such accidents.
