Sažetak
The Constitutional Amendments of 2000 and the new Local and Regional Self-government Act of 2001 provided foundations for forthcoming decentralization of public administration, in accordance with the expressed needs and requirements of local self-govemment units. The process started by transferring part of functions in health care, social welfare, secondary education and elementary education to counties, as well as elementary education to a certain number of towns. This phase of decentralization has also been accompanied by transferring part of earmarked revenues, due part of income tax, which has ensured a free course of transferred functions. However, counties and towns appear only as transmission of means for the needs of elementary schools, because the earmarked funds have been determined by the Decision of the Government of the Republic of Croatia on criteria and standards for ensuring the minimal financial standard of public needs of elementary education, according to the kinds of expenses. Such phased transfer of only part of functions of particular activities has kept divided responsibility between the central and local governments, not only because of the way of financing, but also because of the fact that the rights of establishment have not been transferred in time. Competencies of counties and towns in performing activities which refer to elementary education are neither complete nor full, and therefore counties and towns are not independent in performing activities which should fall within their self-government scope. In the next phases of decentralization such deficiencies should certainly be avoided and all the preparations for full decentralization should be made in due time. If the great variety of local self-government units with respect to their size, fiscal capacity and personnel equipment is an obstacle, then for full decentralization “pilot" counties and towns should be chosen.
