Identity of carrier under time charter

Sažetak

The identity of carrier under time charter contracts is one of the classical questions in law regulating carriage of goods by sea. Cargo claimants are often not sure to whom they should sue: the shipowner or the charterer. A comparative review of various national laws shows that there is a wide spectrum of approaches to problems concerning the identity of carrier. This paper attempts to search beneath the surface of the problem and to examine its background. The author's intention was not to offer a complete solution of the problem but only to look at it from a different perspective and to offer advice on how to deal with it. We hope that even within this limited scope this paper would help to those who're interested in this topic.
