Sažetak
Under the shipbuilding contract if the respondent - shipbuilder is not entitled to dispose of a ship under construction, a dammage, suffered by the respondent because of ordering the provisional measure of the prohibition of the alienation or other kind of disposal of the ship under construction, is only slight. In that case an applicant must not show the existence of a danger that without such provisional measure the respondent will make it impossible or very difficult to obtain payment. The probability of the existence of the applicant's claim is primarily considering under the shipbuilding contract.
