Unseaworthiness of a ship : [case review]

Sažetak

Appointment a person, who was convict of a misdemeanor for serious and repeated violations of safety of navigation, as master of a ship, may result in the ship unseaworthy. Article 742.3 of the 1994 Croatian Maritime Code specifies the cases in which the ship is by law regarded as unseaworthy, and includes at the end the words ''or on any other grounds''. A deliberate appointment of a person who continuously violates basic rules on safety of navigation as master of the ship, qualifies for this very category with regard to the nautical, commercial and administrative function of the master.
