Application of Electronic Surveillance in Different Stages of Criminal Proceedings

Sažetak
Even though the permanent implementation of electronic monitoring in the Croatian criminal justice system has been discussed and announced several times, it was only with the adoption of the Ordinance on Conditional Release with Electronic Monitoring that the legal prerequisites for its application were ensured. Before the Ordinance entered into force, the Croatian Ministry of Justice and Public Administration signed a contract for the procurement of 200 sets of equipment for electronic monitoring with associated software, equipped and organised the Monitoring Centre, and secured officers to supervise prisoners on conditional release with electronic monitoring. After the Ordinance entered into force and once the above-mentioned prerequisites had been ensured, the Ministry organised two meetings with enforcement judges to present them with the functioning of electronic monitoring, as well as the possibility of its application to conditionally released offenders in accordance with the Ordinance. On 19 September 2022, the first conditionally released offender was placed under electronic monitoring (the offender was required not to leave his home between 11:00 p.m. and 6:00 a.m.). In the meantime, the Ordinance on the Method of Executing Pre-trial Detention in the Home also entered into force, which, through a bylaw, regulates the implementation of pre-trial detention in the home and offers a new legal alternative when determining pre-trial detention. In the paper, the authors first provide an overview of current trends in the application of electronic monitoring in Europe, followed by a presentation of the results of a preliminary survey of the judges’ views on electronic monitoring after it was introduced in the phase of conditional release. Given that its introduction is planned in the pre-trial detention phase as well, in conclusion, the authors offer guidelines and proposals for the wider application of electronic monitoring for conditionally released offenders and suspects in investigative detention
