The Legal Framework Regarding the Compassionate Use of Drugs in the Republic of Croatia within the European Legal Context

Sažetak
The obligation of the legislative system of every civilized social society is to provide its health
care users with the highest possible quality of health care service. Certain diseases for which there
is no cure, that is, a suitable method of treatment, have always been a part of the medical reality
all over the world, while the development of the pharmaceutical industry and clinical trials in this
regard seek to mitigate and minimize such medical reality.When we appreciate these facts - the
compassionate use of drugs fulfils its meaning in real life. At the level of the European Union,
there are legal sources that serve to universally define the concept of compassionate use of drugs as well as guidelines regarding the establishment of procedures for the compassionate use of drugs,
while member states are left with the possibility of independently regulating this sensitive issue
with their own legal framework. As a member state, the Republic of Croatia follows the regulatory
framework of the European Union and accordingly establishes its own legal framework that enables
compassionate use of drugs. The authors of this paper will present the current legal framework
regarding compassionate use of drugs in the Republic of Croatia by studying and analyzing the
relevant legal regulations and by-laws, pointing out the weaknesses of the current legal framework
and the problem areas of this method of medical treatment, and by comparing with the legal
regulations within individual member states, pointing out to possible solutions de lege ferenda.
