The Use of Means of Coercion in Private Security Tasks in the Area of the Istria Police Administration From the Beginning of 2020 to the End of 2023

Sažetak
The legal use of means of coercion in private protection is a reason for the exclusion of illegality, although it is not expressly prescribed as such by the Criminal Code. Cases in which the use of coercive means is permitted are prescribed by the Private Security Act but also by international law, which ranks above domestic legislation. The Convention for the Protection of Human Rights and Fundamental Freedoms is the most important in this domain. This research aims to investigate and understand the real situations and reasons why security guards will use coercive means when performing security duties and applying their legal powers. To make such a judgment, statistical data on the use of means of coercion based on the Private Security Act in the Istria Police Administration in the period from the beginning of 2020 to the end of 2023 were analysed and presented. The research includes variables related to means of coercion (type, method of use, legal basis, duration of use of means of coercion, method of decision-making on application, consequences, remarks, reporting to the police, assessment of legality, initiation of proceedings against security guards), application of other powers (giving warnings and orders, restriction of freedom of movement, venue security), characteristics of the event (type of place, time of day, reason for action, number of eyewitnesses), characteristics of the security guard (experience, age, professional qualifications) and characteristics of the person over whom authority is exercised (age, condition/alcoholism/narcotics, previous criminal record, citizenship).
