Sažetak

The aim of this paper is to examine whether, and to what extent, the idea of introducing the institute of the administrative contract into the Croatian legal system has been realised at the normative level. The paper explores the elements of the general legal regime of administrative contracts that limit the broader use of this instrument in practice and highlights examples of inappropriate application of administrative contracts in specific administrative areas. It first sets out the reasons behind the introduction of administrative contracts into the Croatian legal system and then analyses the general legal framework for such contracts laid down in the General Administrative Procedure Act. Furthermore, it examines the regulation of administrative contracts in special administrative areas, including examples of contracts whose nature as administrative contracts has been addressed in case law. The paper concludes by assessing whether, after more than fifteen years of application, the legal regulation of administrative contracts has fulfilled the expectations associated with this institute.
