Abstract

The aim of this paper is to analyse the basic principles and criteria on the basis of which the European Court of Human Rights makes assessments and determines whether, in specific cases, there has been a violation of non-discrimination. Furthermore, the paper seeks to determine which questions must be addressed when applying the discriminatory test, which party bears the burden of proof, and what conclusions may be drawn from selected judgements of the European Court of Human Rights in the field of administrative law.
