Sažetak

The family relationship between parents and a child begins with the child’s birth, and the rules regulating the institutes for establishing the truth about the origin are the basis for determination the legal dimension of this relationship, which places it under protection in various legal spheres. Therefore, it is important that these norms enable timely harmonization of the factual and legal circumstances, and open up space for the realization of the human right to private and family life.
The paper deals with the issue of the effectiveness of national mechanisms for protecting the identity of an individual through the right to know the truth about the origin, and the compliance of national solutions with international and European standards of protection in the subject area. Relevant global and regional international documents are analyzed, as well as the practice of the European Court of Human Rights, which is significant for the future development of Croatian family legislation in the part that regulates the mechanisms for establishing and contesting maternity and paternity. An assessment of the current legal framework is given, and the necessity of legal reforms is indicated in order to ensure more effective protection of the right to know the origin and the protection of the identity of an individual. The paper also emphasizes the importance of conducting further analyses that will encourage the necessary legislative changes.
