Abstract

The subject of this paper is the protected tenancy institute in the Republic of Croatia, with particular emphasis on the origin of protected tenancy rights and the rights and obligations of the contracting parties within this legal relationship. The paper primarily relies on an analysis of the relevant legislative framework governing, or previously governing, this area and includes a presentation and analysis of pertinent case law concerning protected tenancy. The aim is to compare the practice of Croatian courts with that of the European Court of Human Rights, whose decisions have been based on the application of the Convention for the Protection of Human Rights and Fundamental Freedoms. Among the analysed judicial decisions, the judgment in the case of Statileo v. Croatia stands out as a landmark ruling in the field of protected tenancy. Furthermore, the paper seeks to provide a chronological overview of the manner in which the Croatian legislator has addressed the issue of protected rent, beginning with the Apartments Lease Act of 1996 and culminating in the Act on the Enforcement of Judgments of the European Court of Human Rights in the Group of Cases Statileo v. Croatia and the decision of the Constitutional Court of the Republic of Croatia from 2024.
