REGULATION OF STATE AIDS IN THE SHIPBUILDING SECTOR AT THE INTERNATIONAL LEVEL, IN THE EUROPEAN UNION AND THE REPUBLIC OF CROATIA

Sažetak
This paper provides a brief review of the development of the shipbuilding industry
after the ending of the Second World War, emergence of Japan, South Korea
and China as new shipbuilding nations and the loss of dominance of the European
shipbuilders on the global shipbuilding market. It also analyses the developments in
the world shipbuilding policy with the emphasis on state aid policy in shipbuilding
sector. It describes the situation that existed in 1990s, when OECD Agreement on
shipbuilding subsidies was reached. The paper also offers reasons why that Agreement
never came into force. Special attention is drawn to the European state aid law
in the shipbuilding sector and case law of the European Court of Justice and the
European Commission in that field. European Commission Framework on state aid
to shipbuilding, which provides the rules for assessing state aid to shipbuilding, is
being analysed. The paper also describes the present situation in the shipbuilding
sector of the Republic of Croatia and its perspective.
