Abstract

Acts of piracy in contemporary international navigation have considerably increased and represent a great danger to the safety of maritime sailing, to property and to human life. Analysis of the legal effect of piracy (maritime theft) is a very current topic. In the first part of this paper, the author analyses, from an international legal perspective (reference is made especially to the Convention on the Law of the Sea), the cumulative conditions which must be fulfilled for this international crime at sea to exist. Methods of repression on the part of the state are particularly relevant. Certain changes and amendments within the traditional concept of piracy are suggested with the aim of more effectively combating this contemporary phenomenon of crime at sea. In the second part, from the point of view of maritime law, the author analyses, on the basis of international conventions and domestic law , the act of piracy as an occurrence which, with the institution of exceptional circumstances, affects the responsibility of the carrier in the carriage of goods.
