Abstract

The new Maritime Code (entered into force in December, 2004) introduces the terms "carrier", "ship manager", "company" and "employer". The article analyses their legal personality, liability and role in modern marine business and compares them with specific marine and legal entities, such as ship operator and ship owner. The article studies, in particular, the reasons which prompted the legislator to extend the scope of liable persons on the side of the ship. The task is aimed at answering the question as to whether the new Maritime Code has adequately regulated the issue of persons liable for marine claims and claims arising from use of ships. The article points out the importance and benefits of certain changes, but also the disadvantages of the new Code, explores possible solutions and puts forward concrete proposals de lege ferenda.
