Abstract

The General Administrative Procedure Act of 2009 represents a significant novelty in Croatian administrative procedural legislation. It, for the first time in Croatia, among other things, has implemented general legal regulation of administrative contract. It in particular regulates numerous issues over administrative contracts such as conditions of formation and their subject, their futility, amendments, discharge and finally administrative protection for parties when public legal bodies do not fulfil their contractual obligations. This paper analyses court protection of rights both pursuant to Administrative Dispute Resolution Act and pursuant to laws which regulate administrative contracts in the area of public procurement, concession and public-private partnership.
