Regime of general acts following the Law of administrative disputes

Abstract

Analysis of the position of general acts and their impact within the Croatian legal system has not been thouroghly examined in the last twenty year of its independence. By the enforcement of the Act on Administrative Disputes (The Official Gazette, No. 20/2010 and 143/12), the interest for the legal nature and division has been activated due to many questions that would arise in the course of the judicial control over the legality of those acts. The author tries to bring closer the types of the general acts and examines their legal nature thereto. With regard to it, division of the acts on the internal and external ones withreview to their legal nature seems to be of the special importance for the better understanding of the High Administrative Court's competence. Also, the author analysed the Decision of the Constitutional Court of the Republic of Croatia, No. U-II-5157/2012 from March 5, 2012 (The Official Gazette, No. 41/2012) that clearfied the starting difficulties in the interpretation of legal norms that enabled the High Administrative Court to excersize the judicial control over the general acts within the Croatian legal system.
